Legal Framework

The EBRD through its Legal Transition Programme has implemented projects to establish a robust alternative dispute resolution framework in Moldova. The initiative has been supported by the United Kingdom's Good Governance Fund and USAID. Implemented in close partnership with the Ministry of Justice and the Mediation Council, with assistance from CEDR and IDLO. The new Law on Mediation and the Status of Mediator was published on 12 March 2026 and will be implemented on 12 September 2026, replacing the previous Mediation Law of 2015. This is enacted legislation with a future effective date. The law introduces mandatory mediation for civil disputes worth up to 50 average salaries in the economy, as well as family disputes related to parental rights and other disputes between spouses or family members, with exceptions for family violence and divorce cases. Labor disputes are exempted from the fee for the first mediator's session. The law establishes the Union of Mediators to supervise mediation quality and requires mediators to be licensed and participate in annual professional training.

Court System

The court process in Moldova can be unpredictable and slow, creating incentive for ADR adoption. The Ministry of Justice and Mediation Council work to integrate mediation into the justice system. Under the new law, parties will only be able to bring a case to court after attending at least one mediation session for certain types of disputes. To encourage amicable settlement, the state fee is reduced by 25% if parties have attended a mediation session before filing a court application, even if it ended without settlement. The law provides for installment payment of state duty and conditions for refund in certain ratios if dispute is resolved through mediation.

Mediator Regulations

The new Law on Mediation and the Status of Mediator requires mediators to be licensed. Starting 12 September 2026, obtaining a license to practice as a mediator becomes mandatory. The license is issued by the Ministry of Justice for an indefinite term upon payment of a fee of 450 lei. The license form is a strictly accountable document ensuring individualization and confirmation of legal basis for issuance. Mediators must be licensed, participate annually in professional training, and respect strict ethical standards. The Union of Mediators will coordinate mediator activity at national level, ensure compliance with professional ethics and discipline, and manage initial and continuous training. Currently only a mediator's certificate is issued based on qualifying exam results.
