Kingdom of Tonga dedicated to furthering development of arbitration. International Arbitration Act 21 of 2020 passed 10 December 2020, came into force 3 March 2021. The Act is modelled on UNCITRAL Model Law on International Commercial Arbitration (1985) with amendments as adopted in 2006. Contains provisions adapted from leading arbitration seats including Australia, Hong Kong, and Singapore. Tonga acceded to New York Convention 12 June 2020, came into force 10 September 2020.
Court System
Section 9(1) and (2) of Act deals with arbitration agreement and substantive claim before court, adopting Article 8 of Model Law with additional subsections. Section 44 allows parties to apply to court to determine any question of law arising in proceedings that substantially affects rights of parties.
