Lithuania Mediation Research
Legal Framework
Lithuania is an EU member state with the Mediation Law (Lietuvos Respublikos Mediacijos įstatymas) adopted in 2021. The government and justice practitioners are aware of the advantages of mediation. Judicial mediation is conducted only by judges entered in the list of mediators of the Republic of Lithuania, administered by the State Guaranteed Legal Aid Service (VGTPT) since January 2019. The institute of mediation has been introduced in administrative proceedings. From 1 January 2025, amendments to the Mediation Law came into effect establishing the Lithuanian Mediators Chambers (LMR) as the self-regulatory body for mediators, with all mediators in the Mediators List (except judges) automatically becoming LMR members. From 1 January 2026, mediators must submit annual activity reports to LMR by 1 March each year, reporting the number and type of mediations conducted in the previous calendar year. In 2026, Lithuania proposed amendments to the Criminal Code to establish mediation as an official tool for genuine reconciliation, with courts required to dismiss criminal cases if parties successfully complete mediation and sign a peaceful settlement protocol. This is a legislative proposal, not enacted law. The state plans to fund up to eight hours of mediation services regardless of participants' financial status. Lithuania follows civil law traditions with strong EU integration.
While Lithuania operates under this legal framework, The Olive Branch's remote mediators bypass local court backlogs by providing swift, confidential, and mutually agreed-upon resolutions online.
Court System
Lithuania's court system operates under civil law principles with EU influence. Judicial mediation is conducted by judges entered in the official mediator list. The State Guaranteed Legal Aid Service administers the mediator list. From 1 January 2025, LMR assumed many important functions in mediator activity management from VGTPT. The relationship between courts and ADR is based on EU frameworks and national legislation. Courts support ADR through judicial mediation in civil cases and administrative proceedings. In 2026, proposed criminal mediation rules would require courts to dismiss cases after successful mediation rather than merely permitting dismissal.
Mediator Regulations
The list of mediators of the Republic of Lithuania is administered by the State Guaranteed Legal Aid Service. Judicial mediation is conducted only by judges entered in the mediator list. From 1 January 2025, all mediators in the Mediators List (except judges) automatically became LMR members, with mandatory membership in LMR. From 1 January 2026, mediators must submit annual activity reports to LMR by 1 March each year, reporting the number and type of mediations conducted. LMR is responsible for managing these reports and timely public publication of aggregated data. Professional standards for mediators are regulated through EU and national frameworks. Specific licensing requirements follow EU and Lithuanian practices. Mediator training programmes available through national institutions.
Cultural Approach
Lithuania's cultural approach to ADR reflects its EU membership and civil law heritage. The government and justice practitioners' awareness of mediation advantages indicates strong institutional commitment. The introduction of mediation in administrative proceedings suggests broad ADR acceptance. The EU context supports European ADR standards and cross border cooperation.
Typical Costs
As an EU member, Lithuania ADR costs are determined according to EU and national practices. The State Guaranteed Legal Aid Service may provide subsidized mediation for eligible parties. Court-annexed mediation may have regulated fee structures. Costs are typically shared between parties unless otherwise agreed. EU funding may support certain ADR services.
