Legal Framework
Cuba has developed a modernized regulatory framework for alternative dispute resolution in commercial matters. On 22 February 2023, the Council of State enacted Decreto-Ley No. 69/2023 'Sobre la Mediación de Conflictos,' which regulates mediation as a voluntary, confidential, and flexible method for managing and resolving conflicts. The law applies to civil, family, commercial, real estate, labor, social security, criminal, administrative, and environmental conflicts. Mediators must be graduates in Law, Psychology, or Sociology, with no criminal record, and must complete an authorized habilitation course. Psychology and Sociology graduates can only act as co-mediators with lawyers. The National Registry of Mediators is maintained by the Ministry of Justice. On 16 October 2024, Decreto-Ley No. 87/2024 'Sobre Arbitraje y Mediación Comercial Internacional' was enacted to establish broader regulation of international commercial arbitration and mediation in accordance with current international standards. The law applies to international commercial arbitration without prejudice to multilateral or bilateral treaties. On 22 January 2025, the Chamber of Commerce issued Resolution 11/2025 approving the Regulation on arbitration and mediation rights, procedure costs, and party costs.

Mediator Regulations
Under Decreto-Ley 69/2023, mediators must meet specific requirements: be a graduate in Law, Psychology, or Sociology; not be subject to circumstances that disable civil rights; not be sanctioned for acts that would diminish public concept; and pass an authorized habilitation course in mediation. Mediators must be registered in the National Registry of Mediators maintained by the Ministry of Justice. Graduates of Psychology and Sociology can only act as co-mediators together with lawyers. Graduates of other professional fields may participate as third-party specialist auxiliaries when their technical knowledge is needed. The National Registry of Mediators handles habilitation. The Organización Nacional de Bufetes Colectivos and authorized institutions can appoint mediators once registered. Mediators may be disqualified for failing to meet requirements or violating principles. The head of the mediator registry decides on disqualification upon motivated request from the maximum responsible of the institution where the violation occurred.
