Croatia Mediation Research
Legal Framework
Mediation in Croatia follows the Code of Civil Procedure and the new Mediation Act (Zakon o medijaciji) published in Official Gazette NN 27/2026 on 18 March 2026, effective 26 March 2026. The Act replaces the previous Law on Peaceful Dispute Resolution (OG 67/23). The Act defines mediation as a voluntary and confidential process for resolving disputes in civil, commercial, labour, family, administrative and other disputes related to rights which parties may freely dispose of. The Act applies to mediation in Croatia regardless of whether parties have domicile or residence in Croatia, another EU member state, or abroad. The Act introduces mandatory mediation for disputes arising from succession (probate) proceedings and small value damage claims, excluding labour law and insurance disputes. The Act establishes the National Mediation Centre (Nacionalni centar za medijaciju) as a state body with exclusive competence to mediate in mandatory mediation cases. The Centre for Peaceful Dispute Resolution, established in July 2023, continues as the National Mediation Centre with regional centres in Split, Rijeka and Osijek.
While Croatia operates under this legal framework, The Olive Branch's remote mediators bypass local court backlogs by providing swift, confidential, and mutually agreed-upon resolutions online.
Court System
Croatian courts encourage mediation before proceeding to trial. The new Mediation Act requires parties to attempt mediation before initiating civil actions for certain disputes, with cost penalties for non-compliance in the form of forfeiture of right to reimbursement of court costs regardless of outcome. Courts may refer parties to mediation and can adjourn proceedings to allow mediation to occur. The National Mediation Centre conducts information sessions on mediation and mediation procedures free of charge. The Centre has regional centres in Split, Rijeka and Osijek to ensure access across the country. The judiciary is implementing mediation programmes in many courts, particularly in family courts. Judges may suggest mediation at any stage of proceedings. Courts may consider costs orders where parties unreasonably refuse to mediate.
Mediator Regulations
The new Mediation Act further regulates requirements for acquiring mediator status to ensure high level of expertise. The Act provides for a Code of Ethics for Mediators laying down professional standards and rules of conduct. The National Mediation Centre has authority to give and recall consent to mediation institutions and education programs, conducts professional training for mediators, and keeps the register of mediators and mediation institutions. Mediators in Croatia are not required to be lawyers, but many are. Certified mediators must complete continuing education requirements. There are several professional associations for mediators in Croatia, including the Croatian Mediation Association (Hrvatska udruga za medijaciju).
Cultural Approach
Croatian mediation culture emphasises relationship preservation and consensus. There is growing acceptance of mediation as an alternative to litigation. The approach tends to be informal and facilitative. Croatian mediators often take a neutral role in helping parties reach agreements. The cultural context values harmony and preserving relationships. Family mediation is particularly well developed. Commercial mediation is gaining acceptance in business circles.
Typical Costs
Commercial mediation in Croatia typically costs EUR €150-300 per hour or daily rates of EUR €1,000-2,500. Family mediation typically costs EUR €120-250 per hour. Court-annexed mediation may be subsidised or available at reduced rates. Small claims mediation may be free or low-cost. Costs are typically shared between parties unless otherwise agreed. Legal Aid (pravna pomoć) may be available for family mediation in eligible cases. Mediation costs are generally tax-deductible for businesses. The cost savings compared to litigation are significant.
