Legal Framework
Mediation in Croatia follows the Code of Civil Procedure and the new Mediation Act (Zakon o medijaciji) published in Official Gazette NN 27/2026 on 18 March 2026, effective 26 March 2026. The Act replaces the previous Law on Peaceful Dispute Resolution (OG 67/23). The Act defines mediation as a voluntary and confidential process for resolving disputes in civil, commercial, labour, family, administrative and other disputes related to rights which parties may freely dispose of. The Act applies to mediation in Croatia regardless of whether parties have domicile or residence in Croatia, another EU member state, or abroad. The Act introduces mandatory mediation for disputes arising from succession (probate) proceedings and small value damage claims, excluding labour law and insurance disputes. The Act establishes the National Mediation Centre (Nacionalni centar za medijaciju) as a state body with exclusive competence to mediate in mandatory mediation cases. The Centre for Peaceful Dispute Resolution, established in July 2023, continues as the National Mediation Centre with regional centres in Split, Rijeka and Osijek.
