Legal Framework

Cambodia has developed an Alternative Dispute Resolution system. The National Authority for Alternative Dispute Resolution (NADR) was established on 2 November 2023 by Royal Decree No. NS/RKT/1123/2381 to provide mediation and conciliation services for civil, commercial, and other disputes based on mutual consent or party request. The National Commercial Arbitration Centre (NCAC) handles commercial disputes through arbitration and mediation. The Arbitration Council resolves labor disputes. Following NADR's establishment, several legal frameworks were enacted in 2024: Decision No. 002 on formalities, procedures, and qualifications of NADR mediators; Decision No. 004 on the statute of NADR mediators dated 29 February 2024; Decision No. 005 on uniforms, logos, and name tags of NADR mediators dated 4 March 2024; Decision No. 006 on the code of ethics and code of conduct of NADR mediators dated 29 March 2024; and Decision No. 007 on formalities and procedures for mediation of NADR dated 19 April 2024. In April 2026, the Ministry of Justice participated in discussions on institutionalizing mediation and strengthening investor-state dispute resolution systems, considering accession to the Singapore Convention on Mediation. The government is scaling up out-of-court dispute resolution mechanisms as part of justice sector reforms under the Pentagonal Strategy.

NADR mediators must be of Khmer nationality, have no criminal record, and possess one of the following qualifications: Bachelor's degree in law or related field with 2 years of relevant experience; Bachelor's degree in other fields with 3 years of relevant experience; or at least 5 years of relevant experience without a degree. Mediators receive training in legal skills and dispute resolution and must adhere to the code of ethics and code of conduct established by the Ministry of Justice. The NCAC maintains professional standards for mediators and arbitrators in commercial disputes. The Arbitration Council has its own mediator standards for labor disputes. Decision No. 004 of 29 February 2024 establishes the statute of NADR mediators, and Decision No. 006 of 29 March 2024 establishes the code of ethics and code of conduct. Decision No. 007 of 19 April 2024 provides formalities and procedures for mediation.
