Benin is a member of the Organisation for the Harmonisation of Business Law in Africa (OHADA) which has adopted a uniform law on arbitration applicable to its 17 member states. The civil law system provides framework for dispute resolution. On 24 June 2026, the National Assembly adopted Law n°2026-11 modifying Law n°2009-22 of 3 January 2014 on the Mediator of the Republic. The new law modifies articles 1, 2, and 3 of the previous law. Under the new framework, the functions of the Mediator of the Republic are exercised by the first vice-president of the Economic and Social Council (CES). Given the current composition of the CES, this role falls to Razacki Amouda Issifou. The Mediator of the Republic is an intercessor between the public administration and the administrated, independent and cannot receive instructions from any political or administrative authority. The Mediator can participate in conciliation activities between the public administration and social or professional forces at the request of the President of the Republic or the President of the CES. Any physical or moral person who considers that the central state administration, a decentralized local authority, or a public establishment has not functioned in accordance with its public service mission may seize the Mediator by request. The Mediator cannot be seized when the dispute opposes private persons, opposes the public administration to its agents, is pending before justice, or concerns denunciation of a judicial decision. The Mediator cannot be searched, arrested, detained or judged for opinions emitted or acts accomplished in exercise of functions.
