Legal Framework

Armenia has established the Arbitration and Mediation Centre of Armenia (AMCA) as an independent, impartial, internationally recognised arbitration and mediation institution based in Yerevan. AMCA is cosponsored by the Armenian Bar Association, the Armenian General Benevolent Union, and the Centre for Legislation Development Foundation of the Ministry of Justice of the Republic of Armenia, with support from international development organisations and international experts in commercial dispute resolution. AMCA's initial operational budget is principally provided by the European Union. AMCA administers resolution of disputes by arbitral tribunals in accordance with its Arbitration Rules and by accredited mediators in accordance with its Mediation Rules.

Court System

AMCA operates as an independent institution separate from the court system. Parties choosing AMCA arbitration or mediation agree to resolve disputes outside the court system. AMCA's Arbitration Rules reflect international best practices and are based on ICC Arbitration Rules. Under AMCA arbitration rules, parties have complete freedom to choose arbitrators, language of arbitration, and applicable law. If parties cannot agree on a presiding arbitrator, AMCA's Arbitration Council will appoint an arbitrator acceptable to the parties. The relationship between courts and AMCA is based on party autonomy in choosing dispute resolution mechanisms.

Mediator Regulations

AMCA's Arbitration Council is comprised of leading international arbitration practitioners around the world and in Armenia, chaired by Grant Hanessian, former U.S. member of the International Court of Arbitration of the ICC in Paris. The Council oversees arbitrator appointments and administration of Arbitration Rules. AMCA facilitates resolution through accredited mediators in accordance with Mediation Rules. Professional standards and qualifications are regulated by AMCA's international standards. The Armenian Bar Association is represented on the AMCA Board of Trustees by Levon Golendukhin.
